1. Scope

These General Terms and Conditions (GTC) apply to all orders placed through the online shop shop.artandfact.ch operated by ArteFact GmbH, Stockerstrasse 32, 8002 Zurich, Switzerland. Deviating terms and conditions of the customer will not be accepted unless we expressly agree to their validity in writing.

2. Offer and Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer but an invitation to place an order. The purchase contract is concluded once you click the "Buy Now" (or equivalent) button during the checkout process and the payment has been successfully completed. You will then automatically receive an order confirmation by email.

3. Price and Shipping Costs

All prices are stated in Swiss francs (CHF) and include statutory value-added tax (VAT).

Customs duties and import fees for deliveries outside Switzerland are borne by the customer. Final shipping costs are shown in the shopping cart before checkout.

4. Payment Methods

We accept the following payment methods:

  • Credit Card (Visa, MasterCard, American Express)
  • Apple Pay
  • Google Pay
  • Union Pay

Payments are processed exclusively in CHF. Your payment method will be charged immediately after the order is completed.

5. Shipping

Delivery and shipping terms are governed by our current Shipping and Returns Policy, available under Shipping and Returns.

6. Returns

The right of return is governed solely by our Shipping and Returns Policy, available under Shipping and Returns.

7. Custom-Made Products

Custom-made or personalized products are excluded from the right of return unless there is a manufacturing defect or fault.

8. Warranty

Swiss statutory warranty provisions apply. Obvious defects must be reported in writing within 7 days of receiving the goods.

9. Liability

We are liable only for damages caused by intent or gross negligence. Liability for indirect or consequential damages is excluded to the extent permitted by law.

10. Retention of Title

The goods remain the property of ArteFact GmbH until full payment has been received.

11. Communication

Legally relevant declarations (e.g., notices of defects, withdrawals) may be sent by email to redefined@artandfact.ch.

12. Data Protection

The processing of personal data is governed by our Privacy Policy.

13. Jurisdiction and Applicable Law

Swiss law applies exclusively, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is Zurich, Switzerland.

14. Severability Clause

If any provision of these GTC is found to be invalid, the validity of the remaining provisions shall not be affected.
